The version of these Terms in force at the time of your order applies. Our offer is directed at consumers.
The presentation of products in the online store does not constitute a legally binding offer but an invitation to place an order. By submitting your order via the button at the end of the checkout, you make a binding offer to purchase the goods in your cart. Receipt of your order is confirmed automatically by email without delay; this acknowledgement of receipt does not yet constitute acceptance of the contract. The purchase contract is concluded as soon as we separately confirm acceptance of the order or dispatch the goods.
All prices shown are final prices in Australian dollars (AUD). Any shipping costs are shown separately in the checkout before you complete your order; the total shown there is the amount you pay. There are no hidden costs.
The available payment methods are shown at checkout. Payments are processed by external payment service providers; their own terms additionally apply to their processing.
We deliver to the delivery areas specified in our checkout. Details on shipping costs, processing times, delivery times and delivery areas can be found on our “Shipping & Delivery” page.
As a consumer, you have a 14-day right of withdrawal. The full withdrawal policy and the model withdrawal form can be found on our “Right of Withdrawal & Cancellation” page.
Please note the exception for sealed goods: in the case of contracts for the supply of sealed goods which are not suitable for return for health protection or hygiene reasons, the right of withdrawal expires if the seal has been removed after delivery (exception for sealed goods under applicable law). Our products are liquid feed supplements and are sealed for these reasons. Once the seal has been removed, withdrawal is therefore excluded for the item concerned.
In addition to and independently of the right of withdrawal, we grant you a voluntary 90-day money-back guarantee on first orders. It extends the return period from fourteen to 90 days from delivery. The full conditions can be found on our “Returns & Refunds” page.
The item must be in its original condition: unopened, unused and with the seal intact in the original packaging. This guarantee is a voluntary additional contractual benefit. Your statutory rights, in particular the right of withdrawal and your statutory rights in respect of defective goods (including the consumer guarantees under the Australian Consumer Law), are neither restricted nor replaced by it.
We do not accept returns of opened or unsealed feed supplements. For health protection and hygiene reasons they must not be placed on the market again and are neither marketable nor reusable. They are therefore covered neither by the guarantee under clause 6 nor – once the seal has been removed – by the right of withdrawal under clause 5.
Before any return, please contact us first at info@pfotenfreund.co and quote your order number. We cannot identify or process goods sent to us unsolicited and without prior agreement.
Provisions on damaged or incorrectly delivered items, refused and undeliverable parcels, lost shipments and chargebacks can be found on our “Returns & Refunds” page.
The delivered goods remain our property until they have been paid for in full.
Statutory warranty rights apply. If the delivered goods are defective, you are entitled to the statutory remedies under the applicable provisions, including the consumer guarantees under the Australian Consumer Law. Our products are complementary feed supplements for dogs and cats and are not medicines. They are not a substitute for veterinary examination, diagnosis or treatment, nor for a balanced, species-appropriate diet. The stated recommended daily amount must not be exceeded. Please keep out of reach of children and of animals for which the product is not intended.
If your animal is pregnant, has a pre-existing condition or is receiving medication, please consult a veterinarian before use. Our product information serves to describe the product and does not constitute a claim to cure, alleviate or prevent disease.
We are liable without limitation for damage resulting from injury to life, body or health and for damage based on an intentional or grossly negligent breach of duty. In the event of a slightly negligent breach of material contractual obligations (obligations whose fulfilment is essential to the proper performance of the contract and on whose observance you regularly rely), our liability is limited to the foreseeable damage typical of the contract. Otherwise, liability for slight negligence is excluded. Mandatory statutory liability provisions, in particular under product liability law and the Australian Consumer Law, remain unaffected.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration body.
Should any provision of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
